Apat po kami na magkakasamang OFWs sa Kingdom of Saudi Arabia na nagnanais na ibulgar ang ginagawang panghihikayat ng OFW Net at OFW Holdings Inc. na mag-invest sa kanilang mga proyekto.
Nabatid naman na ang mga sinasabi nilang proyekto ay nasa "incubation stage" pa kaya't kami ay nananawagan sa aming mga kasamahang OFWs na huwag muna silang mag-invest sa mga nasabing organisasyon. Napakahirap ng pera ngayon kaya't dapat lamang na i-invest natin ito sa mga kompanya na matatag at hindi sa mga bagong kompanya na pinag-aaralan pa ang kanilang papasukang negosyo. Hindi tayo dapat mapabilang sa libo-libong OFWs na nag-invest sa ilang pyramiding activities na hanggang sa ngayon ay hindi pa malaman kung kailan mababawi ang kanilang investment na inilaan nila para sa kinabukasan ng kanilang mga pamilya. Bibigyan namin ng daan ang liham ni Administrator Carmelita N. Ericta ng National Statistics Office na nagbibigay-linaw sa naging problema ni OFW Arlyn Diaz-Saito sa kanyang “Request for Change of First Name” sa Officer-in-Charge ng Cabangan Municipal Hall sa Cabangan, Zambales:
Dear Mr. Arriola:
This is in response to your column “Boses ng Pamilyang OFWs” published in IMBESTIGADOR last March 31 on who is authorized to implement RA 9048.
RA 9048 or the “Clerical Error Law” vests civil registrars with the authority to act on petitions for correction on clerical and typographical errors in the civil register or approve changes in a person’s first name without undergoing the judicial process. Under the law, the following are the authorized officials to act on petitions for corrections of clerical errors in the civil register and for changes in the first name:
1. City or Municipal Civil Registrar. This refers to the head of the local civil registry office of the city or municipality who is appointed as such by the city or municipality mayor in accordance with the provisions of existing laws. Since the appointment of a civil registrar is mandatory and permanent for all local government units as mandated by the Local Government Code of 1991, an OIC Civil Registrar cannot validly exercise the power vested by RA 9048. However, when there is an incumbent Civil Registrar who is on leave, travellling on official business or is suspended from perfoming his duties as a consequence of a disciplinary action, the duly designated OIC Civil Registrar can act on petitions under RA 9048. In case, there is no appointed Civil Registrar, DILG Memorandum Circular 2001-92 states that a designated OIC Civil Registrar has no authority to exercise the additional civil registry function of accepting and rendering decisions on petitions under RA 9048.
2. Consul General. The Consul General is the Civil Registrar outside the country. They are authorized to serve migrant Filipinos in foreign countries who cannot return to their place of birth. They are allowed to file petitions before the consular offices in the country where they may be staying. In the absence of a Consul General, the Consul or Vice Consul shall exercise civil registration functions and duties.
3. District or Circuit Registrar. The clerk of the Sharia District Court performing civil registry functions with regards to Muslim Personal Laws which includes all the laws relating to personal status, marriage and divorce, matrimonial and family relations, etc.
We hope that this clarifies the issue on who is authorized to act on petitions under RA 9048.
